Choosing the right flag for your vessel

Choosing a flag state is a significant decision in the ownership and operation of commercial vessels. Registration rules, ownership restrictions, vessel age criteria, technical requirements, initial and annual costs and mortgage registration differ between jurisdictions.

Panama, Liberia, the Marshall Islands, Malta, Singapore, the UAE, Hong Kong and Palau are among the registries that may be considered, depending on the type of vessel and the owner’s circumstances.

The right choice should take into account the vessel’s particulars, the owner’s legal status, technical and operational history, financial obligations, insurance requirements and applicable legal restrictions.

Liberia ship registration

Hong Kong ship registration

Flag of Hong Kong

HONG KONG

The Hong Kong Shipping Register operates under the supervision of the Hong Kong Marine Department and has a clear legal framework for registering commercial vessels, ownership, mortgages and maritime finance.

Registration under the Hong Kong flag requires lawful ownership, the appointment of a qualified representative and compliance with technical and registration requirements. Foreign companies may also use the register if they meet the legal conditions and complete the required registration in Hong Kong.

The register offers provisional registration, permanent registration and demise charter registration.

When registration or a change of flag is reviewed, ownership, corporate structure, transfer documents, the rights of mortgagees and the vessel’s previous registration are assessed.

Palau ship registration

Flag of Palau

PALAU

The Palau International Ship Registry has arrangements for registering vessels owned by eligible foreign individuals and companies, and offers provisional and permanent registration, mortgage registration and bareboat registration.

Acceptance depends on a review of ownership documents, technical condition, inspection history, vessel age and the registry’s legal requirements. For vessels over 20 years old, inspection and the possibility of an age waiver are particularly important.

For bareboat registration and for reflagging a mortgaged vessel, ownership documents, the charter agreement and the consent of the relevant authorities and creditors may be required.

Before registration starts, due diligence on the owner and related parties, screening against applicable sanctions and confirmation of the official body administering the registry are essential.

Ship registration and flag: FAQ

Which country is best for registering a commercial vessel?

The choice depends on vessel type, age, ownership structure, trading area and financing. Panama, Liberia, Malta and the Marshall Islands have different requirements. Suitability must be assessed for the particular vessel.

Can a foreign owner register a vessel under the Panama flag?

Panamanian law allows registration by eligible foreign owners. Ownership eligibility does not guarantee acceptance: the vessel, related parties, intended operations and compliance requirements are also reviewed.

Can vessels older than 15 years be registered in Panama?

Since August 2025, Panama has restricted new registrations of oil tankers and bulk carriers over 15 years old. This restriction should not be extended to every vessel type; current rules must be checked for the particular vessel.

How do the Panama and Liberia flags differ?

Both operate established international registries, but their registration processes, acceptance requirements, costs, ownership and financing rules differ. The choice requires assessment of the vessel and the owner’s circumstances.

How long does changing a vessel’s flag take?

Timing depends on the outgoing and incoming registries, complete documentation, mortgage status, inspections and the issue of certificates. A fixed or guaranteed timeframe cannot be given before reviewing the matter.

Can a mortgaged vessel change flag?

A change of flag may be considered if creditor rights and registry rules are respected. Mortgagee consent, preservation or re-registration of security and coordination between the registries may be required.

How does bareboat registration differ from an ordinary change of flag?

Under a bareboat charter, a vessel may operate under another registry’s flag for a defined period while ownership and mortgage registration remain in the underlying registry under applicable rules. Both registries’ laws must be considered.

How much does registration in Panama or another jurisdiction cost?

Costs vary with tonnage, vessel type and age, registration type and the services required. Representative fees, certificates, inspections and annual obligations must be considered alongside initial registry charges. A reliable estimate requires current quotations based on vessel particulars.

Can a foreign company register its vessel in Hong Kong?

Yes, if it meets the legal requirements. The foreign company must have a structure eligible for ship registration in Hong Kong and appoint a qualified local representative. Ownership, corporate documents, the vessel’s previous registration and technical documents are also reviewed before acceptance.

Can a vessel over 20 years old be registered under the Palau flag?

Registration of vessels over 20 years old in Palau is subject to special review. After inspection, a review of the technical history and confirmation of the required conditions, the registry may decide on a waiver from the age limit. Acceptance of such a vessel is neither automatic nor guaranteed.

Which flag is right for your vessel?

Every vessel has its own operational profile, age, tonnage, ownership structure and legal circumstances. The suitability of a registry can only be assessed after reviewing the vessel’s particulars and applicable rules.
